By doing business with Emnotek LLC you agree to be bound by these terms and conditions. Please review these Legal Terms and Conditions prior to proceeding further or making a purchase. Emnotek reserves the right to change, discontinue, alter or amend these terms and conditions at any time. Emnotek reserves the right to cancel any order for any reason at any time.
Emnotek has no affiliation with any auto maker, all names and trademarkers are used for reference only. Manufacturer names and part numbers are used only for identification purposes. All product pictures on emnotek.com are for reference only, in some cases actual product may vary. Emnotek.com may include links to other sites on the Internet that are owned and operated by third party vendors and other third parties. You agree that Emnotek is not responsible for the availability of, or the content located on or through, any external site. Emnotek is not responsible for pricing or typographical errors.
Shipping
Emnotek is not responsible for any damages or claims arising out of a delay in the processing or shipment of any order. Emnotek is not responsible for any theft of packages that occurs after delivery. Any statements on emnotek.com or made by Emnotek regarding shipping speed or timeframes are not guarantees. Additional shipping charges may apply for items shipping directly from a manufacturer, customers will be notified and have the option of canceling (refund) their order before product(s) ship. On rare occasion an item purchased may not qualify for free shipping even if the product is above a certain dollar amount. In these cases customers will be notified and will have the option of canceling (refund) their order. The vast majority of orders are shipped without a signature being required at delivery. Most customers appreciate the convenience of not being required to be present at the time of delivery. However, there are some orders shipped with a signature required based on the discretion of our fulfillment team. If a customer is concerned about package theft, please be sure to email us prior to placing an order so that we can ensure your package is shipped with a signature required for delivery.
Any warranties for merchandise sold by Emnotek are those made by the manufacturer of each specific product. No warranties are expressed or implied by Emnotek for any products listed in our catalog or on our website. Warranty claims must be filed directly through the manufacturer. If a manufacturer is unresponsive we are happy to step in and help a customer file a warranty claim.
Acceptable forms of payment include VISA, MasterCard, Discover, American Express and PayPal. PayPal is accepted from customers that have shipping addresses verified by PayPal and located in the United States. Credit card payments are not accepted for international orders. We do not offer cash on delivery (COD) as a form of payment, nor do we accept non-US credit cards from outside the United States. All orders are billed in full at the time they are placed. We do not offer delayed billing, lay-away, or payment plans. We will only ship to the confirmed address for the credit card holder. We will not ship orders that do not pass our stringent fraud protection measures, which include gathering the credit card CVV2 digits and verifying the billing address and cardholder information.
It is the responsibility of the customer to insure that the use of their vehicle and items purchased from Emnotek comply with federal, state, and local regulations. Some products may be for off road or show use only, Emnotek makes no representation regarding the legality for street use of any products sold on emnotek.com or any products ability to pass emissions tests in any State. Emnotek assumes no responsibility for any damages or fines incurred due to the misuse or illegal installation of any of its products. Emnotek shall not be liable for any reason for any costs or damages to any person or property arising out of or in connection with the use or installation of any parts that it sells. Customers understand that Emnotek will not be liable for any inconvenience, expense directly or indirectly arising from the use (or inability to use), including installation costs, for any third party's unauthorized use, of any product or its components, either separately or in combination with other equipment, regardless of whether Emnotek had been advised of such possibility.
Pricing
All prices are per item quoted in US dollars. Prices are subject to change without notice. Orders can be canceled (void) (refunded) if pricing errors are found after an order is placed. Emnotek reserves the right to cancel (void) (refund) any order at any time. Emnotek strives to provide accurate product pricing and shipping information. In the event that a pricing or typographical error exists with any product or service offered, Emnotek reserves the right to cancel (void) (refund) an order at any time. In the rare occasion that a pricing error exists Emnotek will contact the customer for further instruction allowing the customer to cancel the order if they prefer. Coupon codes, sales or promotions of any kind cannot be used on previously placed order. Shipping price discrepancies can exist on any order regardless of the weigh or size of a package. If a shipping price error exists Emnotek will contact the purchaser with revised shipping options allowing the customer to cancel the order if they prefer. Emnotek is not responsible for any fees associated with canceled orders. Deposits made by a customer for special order items, or items being shipped from outside the USA are non-refundable.
International Orders
International orders are taken on a case-by-case basis. Credit card payments are not accepted for any international orders, we only accept payments via verified Paypal accounts, Bank Wire Transfer or Money Orders. Countries may charge duty fees, or other taxes based on the product origin and value based on the specific Countries import policy. All additional fees and taxes are the responsibility of the recipient.
Returns
Returns are subject to a repackaging/restocking fee. Returns are accepted for brand new merchandise within 30 days of the purchase date. All returns must be authorized by Emnotek via email and include an RMA number (return merchandise authorization). Returned merchandise must be in 100% brand new condition and in the original manufacturer packaging including all original packing material. Merchandise that has been installed or altered in any way can not be returned. The vast majority of the products sold on our website can be returned without a restocking fee within 30 days. The following products are subject to a 25% restocking fee - Eisenmann brand, Milltek brand, Racing Dynamics brand, Neuspeed brand, and other items per the discretion of Emnotek including shipments that are refused or returned by UPS due to a customers inability to accept a shipment. Special orders for exhausts such as Eisenmann and Milltek cannot be canceled or returned once the items have shipped from Europe. Due to the nature of Sprint Booster products, they cannot be returned. Electrical components are non-refundable. All other brands and products can be returned without a restocking fee, only the shipping fees will be deducted from the return refund. Merchandise determined to be defective can be exchanged for a replacement product if covered by the manufacturers warranty. No refunds or exchanges after 30 days. Customers must use the email address listed on our Contact Us page to receive return authorization and instructions for return. Please include your name, order number, short description of the item (if multiple items were purchased), and the reason for return. Shipping fees for returned items are non refundable. If the original order qualified for free shipping, the actual shipping cost will be deducted from the return. All returns must be shipped prepaid by the customer. Customers will receive a store credit for merchandise returned due to manufacture warranty defect after the return policy period has expired. By placing an order on this website you agree to be bound by these Return Policies.
If we are able to cancel an order before the shipment has been processed, a cancellation fee will be deducted from the refund.
